Terms of Service

Effective August 22, 2026

These terms cover your use of WhaleRing. They are written in plain English on purpose. By using the service you agree to them.

What the service is

WhaleRing is an AI phone answering service for home-services businesses. When a call to your business line is not answered, our service picks up, determines whether the situation is urgent or routine, collects the caller's name, callback number, address, and description of the problem, notifies you about urgent calls, and books routine appointments into your calendar.

The service sits behind your existing phone system. It does not replace your phone provider, and you keep your own number.

What the service is not (read this one)

The service performs call intake. It does not perform emergency response, and it is not a substitute for your own judgment or your own on-call process.

You remain fully responsible for responding to your customers, including in emergencies. Notifications can be delayed or fail for reasons outside our control: carrier outages, network problems, a phone that is off or out of signal, or a caller who hangs up before giving details. You must not rely on this service as the only way you learn about an emergency.

The service does not quote prices, diagnose equipment, or dispatch technicians on its own. If a caller asks directly whether they are speaking to a person, it will tell them they are not.

This service is not for medical, fire, police, or other life-safety emergencies. Callers with a life-safety emergency should hang up and dial 911.

Your responsibilities

  • Give us accurate information about your business, hours, service area, and what you consider an emergency, and keep it current
  • Make sure the people who should receive urgent alerts have working phones and have agreed to receive them
  • Meet any call-recording disclosure obligations that apply to your business and the states you operate in
  • Use the service lawfully, and not for any purpose that would violate telemarketing, robocall, or consumer-protection laws
  • Keep your own process for checking on urgent jobs, rather than relying solely on our notifications

Pricing and billing

The service costs $397 per month, flat. That includes unlimited calls with no per-call or per-minute charges, and setup and ongoing tuning performed by us.

Billing is monthly in advance and starts when your service goes live, or at the end of your free period if you have one. There is no contract and no minimum term.

Prices may change, but not for you without at least 30 days' notice by email, and never during a free trial period.

The founding-customer offer

The first three Phoenix-area companies to sign up get the service free for 30 days. No card is required to start, and there is no obligation to continue.

At the end of the 30 days, billing begins at $397 per month only if you decide to continue. If you say nothing, we will ask before charging you. You will not be enrolled by silence.

Text messaging

If you opt in to text alerts, message and data rates may apply. Message frequency varies with your call volume.

Reply STOP to any message to stop immediately, and HELP for assistance. STOP is honored permanently. Opting out of texts does not cancel the service.

Mobile information will not be sold or shared with third parties or affiliates for marketing or promotional purposes.

SMS alerts begin once our carrier registration is approved. Until then we alert you by email.

Cancellation

You can cancel at any time by emailing r.mizuno@whalering.com. Cancellation takes effect at the end of your current billing month, and we do not prorate partial months. We will not make you sit through a retention call.

We may suspend or end service if the account is not paid, if the service is used unlawfully, or if we can no longer provide it. Except for non-payment or unlawful use, we will give you at least 30 days' notice.

Your data

Your call recordings, transcripts, and customer records belong to you. You can ask for a copy at any time, and you can ask us to delete them.

We handle personal information as described in our Privacy Policy.

Service availability

We aim for the service to answer every forwarded call, but we do not guarantee uninterrupted service. It depends on third-party telephony, network, and AI providers that can fail. We do not offer a formal uptime guarantee, and we would rather say that plainly than promise a number we do not control.

If the service fails for an extended period, tell us and we will credit your account for the affected time.

Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.

We are not liable for indirect or consequential losses, including lost business, lost profits, or damage to reputation, arising from a missed, delayed, or mishandled call or notification.

This does not limit liability that cannot be limited by law.

When something goes wrong

Every call is recorded and transcribed, and we review them. If a call is mishandled, tell us and we will investigate and correct the underlying problem, normally the same day. If we cannot make the service work for your business, we would rather you cancel than keep paying for something that is not earning its keep.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Maricopa County, Arizona.

Changes to these terms

If these terms change materially, active customers will be notified by email at least 30 days beforehand. Continuing to use the service after that means you accept the new terms.
